Terms of Service

This English version is a courtesy translation. The French version is the official version under Quebec’s Charter of the French Language and prevails in case of any discrepancy.

1. Who we are

Staynow is operated by Gestion Guy McKenzie Inc., Montreal, Quebec, Canada (“Staynow”, “we”).

By creating an account or booking on Staynow, you accept these terms. If you do not accept them, do not use the app.

2. What Staynow is — and is not

Staynow is an intermediary platform connecting travellers with short-term accommodation available right now or at very short notice.

Staynow is not the accommodation provider. We do not own, operate, or manage any of the places listed. The stay itself is an agreement between the traveller and the offer owner. We provide the platform, arrival verification, and payment processing.

There are two kinds of offers:

  • Host offers — published by a host whose profile has been validated by Staynow.
  • Transfers — a traveller passing on a reservation they can no longer use. Proof of the original booking is required and reviewed before it goes live.

3. Your account

  • You must be 18 or older.
  • Authentication uses Sign in with Apple. You are responsible for activity on your account.
  • Information you provide must be accurate and current.

4. Prices and payment

The displayed price is computed by our servers and decreases automatically as the offer’s deadline approaches. The price that applies is the one shown when you confirm your booking.

Your card is charged in full at the time of booking, not on arrival. The amount is then held by Staynow and released to the offer owner after you confirm your arrival on site. For an offer published by a validated host, the payout may be made as soon as you book.

Payments are processed by Stripe, including Apple Pay. Staynow does not store your card number.

Staynow charges a 14% commission on the booking price. The remainder goes to the offer owner.

5. Cancellation and no-shows

A confirmed booking is non-refundable, and a no-show is not refunded. If you do not confirm your arrival within the allowed window, the amount you paid is released to the offer owner.

This rule exists because a Staynow offer is pulled from the feed the moment you book it: the place is held for you and cannot realistically be offered to another traveller in the short time remaining. The owner absorbs the loss if you do not show up.

You are refunded only in these cases:

  • Payment fails or the booking is never confirmed: you are not charged.
  • The owner withdraws the offer, or fails to provide valid access instructions before your arrival.
  • The accommodation does not exist, is inaccessible, or clearly does not match the listing — report it before confirming your arrival, by writing to info@staynow.live.

These terms do not limit the rights granted to you by Quebec’s Consumer Protection Act.

6. Arrival confirmation

Arrival confirmation is the step that releases your payment to the owner and unlocks your entry instructions.

  • It requires your precise location, verified by our servers: you must be near the accommodation.
  • It is only possible within the window around the check-in time.
  • Never confirm remotely, or simply because the owner asks you to. This action is irreversible.

7. If you publish an offer

By publishing, you commit to the following:

  • You have the right to offer the accommodation. For a transfer, you genuinely hold the original reservation and provide truthful proof.
  • The listing is accurate: real and current photos, faithful location, dates, and conditions.
  • You provide valid access instructions before the traveller arrives. Without them, no payment can be released.
  • You comply with applicable laws and with the rules of your building, lease, or condominium. In Quebec, tourist accommodation may require CITQ registration; that responsibility is yours.
  • You must complete your Stripe payout setup before you can publish.

Staynow may refuse, remove, or suspend a listing, and suspend an account — in particular for fraud, false proof, misleading listings, or breach of these terms.

8. Payouts

Payouts are made by Stripe to the account you configure. Stripe collects the identity and banking information required by law directly.

You are responsible for your own tax obligations on amounts received, including collecting and remitting any applicable taxes.

9. Prohibited conduct

  • Listing a fictitious or misleading offer, or a reservation you do not hold.
  • Requesting or making payment outside Staynow for a booking made on Staynow.
  • Asking a traveller to confirm arrival before they are actually on site.
  • Impersonating someone else or creating multiple accounts.
  • Using the service for unlawful purposes.

10. Liability

Staynow provides the platform “as is”. We do not guarantee the quality, safety, or legality of any accommodation, nor the conduct of any user.

To the extent permitted by law, our liability to you in connection with a booking is limited to the amount you paid for that booking. Nothing here limits liability that cannot be limited under applicable law.

11. Termination

You can delete your account at any time from Profile → Delete my account. Deletion is refused while a confirmed booking is still awaiting arrival, so that a payment in progress does not get stuck.

We may suspend or terminate an account for breach of these terms.

12. Governing law

These terms are governed by the law applicable in the province of Quebec and the laws of Canada applicable therein. The courts of the district of Montreal have jurisdiction, subject to the rights the law grants you as a consumer.

13. Changes

We may change these terms. Material changes will be signalled in the app, and the last-updated date above indicates the version in force.
